PURSUANT TO COURT REMAND
In accordance with the U.S. Court of International Trade's order in Rubberflex Sdn. Bhd. and Rubfil Sdn. Bhd. v. the United States, Slip Op. 99-68 (July 23, 1999), the Department of Commerce (the Department) has prepared these final results of redetermination on remand with respect to Extruded Rubber Thread from Malaysia; Final Results of Antidumping Duty Administrative Review, 62 FR 62547 (November 24, 1997). The Court directed the Department to repeat the verification of Rubberflex Sdn. Bhd. (Rubberflex). The Court also directed the Department to revise the margin calculation program to convert the ocean freight expenses for Rubfil Sdn. Bhd. (Rubfil) to U.S. dollars and to recalculate Rubfil's U.S. price.
On October 8, 1999, we informed the parties of Rubfil's revised margin calculation and allowed them to review our calculations for programming errors. No comments were received.
II. COURT INSTRUCTIONS
We have followed the instructions of the Court and revised the margin calculation program by converting Rubfil's ocean freight costs to U.S. dollars and recalculating U.S. price.
III. SETTLEMENT OF LAWSUIT WITH RESPECT TO RUBBERFLEX
As a result of settlement negotiations, Rubberflex has entered into an agreement with the Department to settle the litigation and to dismiss the lawsuit.
IV. FINAL RESULTS OF REDETERMINATION
Rubfil's margin for extruded rubber thread for the period October 1, 1993 through September 30, 1994, is 11.81 percent as a result of this remand.
